End User License Agreement (EULA)

This End User License Agreement ("Agreement") covers your use of the Headpat mobile application (the "App"). It applies together with our Terms of Service, our Acceptable Use Policy and our Privacy Policy. Where this Agreement and the Terms of Service differ on the use of the App, this Agreement applies.
The App is provided by Dominic Stilma, Friedhofsweg 10, 49843 Uelsen, Germany ("we", "us"). By installing or using the App you agree to this Agreement.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices that you own or control, for your own non-commercial use. On Apple devices this is limited to Apple-branded products and to the Usage Rules in the Apple Media Services Terms and Conditions.
The App is licensed, not sold. All rights that are not expressly granted to you stay with us.
2. What You May Not Do
Except where the law allows it regardless of this Agreement, you may not:
- copy, modify or create derivative works of the App;
- decompile, reverse engineer or disassemble the App;
- rent, lease, sell, sublicense or otherwise make the App available to others;
- remove or alter copyright, trademark or other proprietary notices; or
- use the App to break the law or our Acceptable Use Policy.
3. Account and Age
Using the App requires a Headpat account. You must be at least 18 years old. The rules for accounts are in our Terms of Service.
4. Content and Conduct
The App shows content created by its users. There is no tolerance for objectionable content or abusive users. What is allowed is set out in our Acceptable Use Policy. You can report content in the App or by email to help@headpat.place, and you can block other users in your Headpat account. We review reports and remove content and accounts that break the rules.
5. Privacy
How we process personal data is described in our Privacy Policy.
6. Updates
We may release updates that change, add or remove features. Some updates are needed to keep using the App.
7. Maintenance and Support
We are responsible for maintenance and support of the App. Contact us at help@headpat.place or at https://headpat.place/support. Apple and Google have no obligation to provide maintenance or support for the App.
8. Warranty and Liability
The App is provided free of charge. Our liability is set out in the "Limitations of liability" section of our Terms of Service. Your statutory rights as a consumer remain unaffected.
If the App does not conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
9. Product Claims and Intellectual Property
We, not Apple or Google, are responsible for addressing claims relating to the App, including product liability claims, claims that the App does not meet a legal requirement, and consumer protection or privacy claims. If a third party claims that the App infringes its intellectual property rights, we are responsible for handling that claim.
10. Legal Compliance
You confirm that you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
11. Third-Party Terms
When using the App you must also comply with applicable third-party terms, such as your mobile data agreement.
12. Apple as Third-Party Beneficiary
If you obtained the App from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of this Agreement. Once you accept it, Apple has the right to enforce it against you as a third-party beneficiary.
13. Termination
This Agreement applies until you or we end it. You can end it at any time by deleting the App. Your rights under it end if you break it. Ending this Agreement does not delete your account; you can delete your account in the account settings.
14. Changes
We may change this Agreement when the App or the law changes. We will tell you about significant changes in the App or by email before they take effect.
15. Governing Law
This Agreement is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in the European Union, you keep the protection of the mandatory provisions of the law of your country of residence, and the courts of that country remain available to you.
